The employees were working in 10 feet deep excavation with no protective system and hazardous oil leaks.  Violation occurred on or about 08/21/2025

29 CFR  1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:  a) 864 Grove street, Irvington, NJ    The employees handling the leaked diesel/heating oil during pumping operations were not provided with appropriate personal protective equipment, such as, but not limited to, eye protection and gloves, to prevent exposure to hazardous chemicals.  The violation occurred on or about 08/21/2025.

29 CFR  1926.651(g)(1)(i):Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, the atmospheres in the excavation was not tested before employees entered excavations greater than 4 feet (1.22 m) in depth:  a) 864 Grove street, Irvington, NJ   The employer did not ensure that the atmosphere of the 10-foot deep excavation was tested prior to employee entry where hazardous atmospheres could reasonably be expected to exist. Employees were exposed to hazardous vapors emanating from leaking diesel/heating oil from the excavation.  Violation occur on and about 08/21/2025
