29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. McKinley Drive, New Britain, CT 06053: On or about September 02, 2026, Employer did ensure that a competent person conducted daily inspections of excavations, the adjacent areas, and protective systems which could prevent possible cave-ins, indications of protective system failures, hazardous atmospheres, or other hazardous conditions. Deviations from the issued construction plans resulted in Employee exposure to unnecessary hazards. A) 85 McKinley Drive, New Britain, CT 06053: An Employee suffered a preventable struck-by injury by a steel I-Beam because a competent person did not prevent unauthorized personnel to conduct Pile Driving operations or inspected the excavations or adjacent areas of hazardous conditions. A protective system to prevent Employee's from cave-in hazards was not in place along the perimeter walls of an excavation which was involved in Pile Driving operations. B) 197 Governor Street, New Britain, CT 06053: A protective system to prevent Employee's from cave-in hazards was not in place along the perimeter walls of an excavation which was involved in Pile Driving operations.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). McKinley Drive, New Britain, CT 06053: On or about September 02, 2026, Employer did ensure protective systems to protect Employees from excavation cave-ins were in place allowing Employee exposure to unnecessary risk. Deviations from the issued construction plans resulted in Employee exposure to injury. A) 85 McKinley Drive, New Britain, CT 06053: Employees were exposed to cave-in hazards while conducting Pile Driving operations within an excavation which did not have adequate protective systems in-place. B) 197 Governor Street, New Britain, CT 06053: Employees were exposed to cave-in hazards while conducting Pile Driving operations within an excavation which did not have adequate protective systems in-place.

McKinley Drive, New Britain, CT 06053: On or about September 02, 2026, Employer deviated from approved construction plans of two coffer dams created by a registered professional engineer without obtaining approval for those deviations exposing Employees to safety hazards. A) 85 McKinley Drive, New Britain, CT 06053: Employer did not follow approved Construction Sequence for fabrication of Structure 2 coffer dam which resulted in an Employee being injured. B) 197 Governor Street, New Britain, CT 06053: Employer continued to deviate from approved Construction Sequence for fabrication of Structure 1 coffer dam which exposed Employees to potential injury.
