29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under § 1926.502(e): On or about September 3rd and 5th of 2025, employees engaged in siding activities on Building 21 of a 425 unit multi-family apartment complex located at 8800 South 33rd Street, Lincoln, Nebraska were exposed to fall hazards in that employees working from the basket of a SkyJack, model SJ63 AJ+, serial number A302000144, were not protected from falls by use of a fall arrest system or positioning device. Instances included but not limited to: i. September 3, 2025 where two employees without fall protection worked from an aerial lift measuring approximately 15 feet, 9 inches from the platform bottom to the next lower level and ii. September 5, 2025, where one employee without fall protection worked from an aerial lift measuring approximately 8 feet from the platform bottom to the next lower level.
