OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that operators of a Montrec, Inc. model 320C  brand Electrical Personnel and Burden Carrier exposed pedestrians to struck by/caught between hazards during vehicular operations:  a)	BPI, Inc., System 1 bagging area of the facility, on or about September 4th, 2025 and times prior thereto:  An employee operating a Motrec, Inc. brand Electrical Personnel and Burden Carrier (Model: E320C; serial # 0809144) operated the vehicle in a manner that created a struck by hazard to pedestrians in the work areas.  An incident occurred in which an operator of the vehicle struck a pedestrian during vehicular operations through an area that contained a "blind spot".  In addition, the vehicle did not have a functional horn or similar sound producing warning device due to the device not being activated prior to operating the vehicle.  An incident occurred in which an employee/pedestrian was struck by the vehicle which resulted in a hip fracture.   ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
