29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)Winter Contracting, LLC at 47491 240th Street, Dell Rapids, SD 57022: On or about and at times prior to September 3, 2025, the exposing employer did not ensure employees were instructed to recognize, avoid unsafe conditions, and control or eliminate the hazards while conducting wet tapping operations on a section of pressurized 24-inch PVC water pipe. This condition exposed employees to explosive struck-by hazards associated with over pressurized Polyvinyl Chloride ("PVC") water lines.

This condition exposed employees to hazards associated with safe egress while working within an unprotected excavation.
