29 CFR 1910.178(l)(4)(ii)(A): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been observed to operate the vehicle in an unsafe manner: On or about August 30, 2025, a powered industrial truck operator attending to a work-place incident did not ensure that a forklift was properly placed in the off and/or parked position before exiting. Employees were potentially exposed to a struck-by hazard due to the forklift rolling backwards outside the trailer unattended on Unloading Dock #32, and the employer did not ensure the operator was retrained on safe operations following the incident. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On or about August 30, 2025, a powered industrial truck operator attending to a work-place incident did not ensure that a forklift was properly placed in the off and/or parked position before exiting. Employees were potentially exposed to a struck-by hazard due to the forklift rolling backwards outside the trailer unattended on Unloading Dock #32. The employer did not ensure the operator was retrained following the incident on ensuring that the forklift was dismounted within 25 ft of the truck still in the operator's view, the controls were neutralized and brakes set to prevent movement. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
