29 CFR 1910.119(d)(3)(i)(B): The employer's piping and instrument diagrams (P&ID) were not accurate. On or about 9/16/2023 and at times prior thereto, at Delek Refinery facility in Tyler Texas, the employer did not ensure that piping and instrument diagrams (P&IDs) were accurate. The P&IDs were not accurate as the following but not limited to. a). In P&ID DK-10-0-0001G Rev. 14 (Bates # R2-000025), the emergency shutdown ESD-024D is associated with safety integrated system SIS-900A, function block 10-PY-02B-LC (from P&ID DK-10-0-0002A Rev.25), and ESD-024C (from P&ID DK-15-0-0001J, Rev. 18) are inaccurate. The nametag ESD-024 is not shown in the distribution control system (DCS). b). In P&ID DK-10-0-0001J Rev. 26 (Bates # R2-000028) 1. The location of PSV-1009A and PSV-1009B are inaccurate. They should be shown at the same location on 10-24"-HC-9A-IA line instead of separation. 2. The 8-inch inlet pipe to PSV 1009B is inaccurate. It should be 6-inch. 3. The 3-inch valve on the bypass line of PSV-1009A is not labeled as normally closed (NC) and car sealed closed (CSC). c). In P&ID DK-30-0-0001B Rev. 18 (Bates # R2-000117) 1. The level controller LC-004 directly associated with flow controller FC-002 (P&ID DK-30-0-0001G Rev. 20) and FC-021 (P&ID DK-30-0-0001H Rev.17) are inaccurate. In P&IDs (DK-30-0-0001G Rev. 20 and DK-30-0-0001H Rev.17), FC-002 and FC-021 are not shown any connection to LC-004. 2. The 2-inch valve on the bypass line of PSV-3007 is not labeled as normally closed (NC) and car sealed closed. (CSC).

29 CFR 1910.119(d)(3)(i)(H): Process safety information (PSI) of safety systems was not accurate. On or about 9/16/2023 and at times prior thereto, at Delek Refinery facility in Tyler Texas, the employer did not ensure that instrument loops diagrams and emergency shutdowns (ESD) listed in a cause-and-effect chart were accurate. The following PSI of safety systems are not accurate but not limited to: a. In the instrument loop diagram, DK-10-3-PT9002A (date: 5/21/15), bates # R4.1-003787, the pressure transmitter PT-9002A located on 10-1"-HC-1017-1CB2S01 line is inaccurate. It should be located on a different 1-inch line. b. The level transmitter 30-LT-004 listed in the instrument loop diagram, DK-30-I3-L004 (date: 5/15/09), bates #R4.1-003859, is inaccurate. The loop should show a connection between 30-LT-004 and flow controller 10-FC-024. c. The level transmitter 30-LT-002 listed in the instrument loop diagram, DK-30-I3-L002 (date: 5/15/09), bates #R4.1-003871, is inaccurate. The loop should show a connection between 30-LT-002 and flow controller 60-FC-002. d. In the loop diagram, DK-30-I3-X1034 (date: 12/20/12), bates #R4.1-005373, the emergency shutdown (ESD) HS-1034 should be connected to 30-HS-1034A instead of 60-HS-1034. ESD-1034 push button does not exist in the field. e. Emergency shutdowns 10-ESD-024A/B/D listed in a cause-and-effect chart (bates # R4.1-005372, date: 6/21/2022) are inaccurate. 1. 10-XV-9000B is a bleed valve instead of block valve. 2. 10-XV-9000C is a block valve instead of bleed valve. 3. Activated 10-ESD-024A, 10-ESD-024B and 10-ESD-024D do not sequentially activate valves (10-XV-9001A/B/C and 10-XV- 9000A/B/C) in positions of "Close-Close-Open and Close-Close-Open". 4. 10-ESD-024D is listed in P&ID DK-10-0-0001G, Rev. 14 (date: 10/24) instead of P&ID DK-10-0-0001J, Rev. 26 (date: 06/25).
