29 CFR 1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: On or about October 4, 2025, at the worksite located at the Kellnersville, Wisconsin water tower, the employer had an employees working from two 30 foot wide modular swing stage Sky Climber scaffolds, and scaffolds were not being inspected by a competent person prior to each work shift for visible defects, such as but not limited to missing guardrail pins.

29 CFR 1926.451(g)(1)(ii):Each employee on a single-point or two-point adjustable suspension scaffold was not protected by both a personal fall arrest system and a guardrail system: On or about October 4, 2025, at the worksite located at the Kellnersville, Wisconsin water tower, the employer had an employee elevate a 30 foot wide modular swing stage Sky Climber scaffold without a complete personal fall arrest system. The employee eliminated the use of the rope grab device in order to accommodate elevating the scaffold controls that were on opposite sides of the scaffolding. The scaffold was missing pins that would lock the guardrails in place, and the employee either knocked the guardrail down with his abrasive blast hose, or the teetering effect of elevating the scaffold with one person caused one guardrail to become dislodged. The employee fell backwards over the guardrail and the missing rope grab allowed the employee to fall approximately 60 feet to the ground below.

29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. On or about October 4, 2025, at the worksite located at the Kellnersville, Wisconsin water tower, the employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a 30' modular swing stage Sky Climber scaffold trained by a competent person to recognize any hazards associated with the work. Employees erected and used the suspended scaffold that was missing multiple pins used to lock the required guardrails in place.
