OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards from contacting overhead power lines. On or about October 27, 2025, employees were transferring harvested soybeans from a tractor-pulled grain cart to a semi-truck trailer. The tractor was placed in a ditch between a side of the road and edge of farm field under the energized power lines. The semi-truck trailer was parked on the road next to the tractor. The grain cart was equipped with an extendable auger that operated near the energized overhead power lines to load the semi-truck. Employees were exposed to hazards associated with equipment contacting the power lines and resulted in a fatality. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1928.57(a)(6): At the time of initial assignment and at least annually thereafter, the employer did not instruct every employee in the safe operation and servicing of all covered equipment with which they would be involved: On or about October 27, 2025, the employer did not ensure employees working with farm field equipment such as a tractor and grain cart equipped with an extendable auger, were instructed on the safe operation of equipment when working in close proximity to energized overhead power lines. Employees were exposed to hazards associated with contacting power lines likely to result in death or serious injury because safe operating means and methods were not provided to recognize and avoid electrical hazards, including safe clearance distances. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
