OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to struck-by hazards of unsecured tooling and broken components while operating press brakes:   a. Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about October 14, 2025, and at times prior, employees were exposed to falling dies and breaking components struck-by hazards likely to result in serious injury or death while operating the Chicago Dreis & Krump 400 and 750-ton press brakes. The employer's provided dies were not tested to establish their structural integrity limits through maximum load rating and capacity prior to bending metal parts such as 1 ? inch abrasive resistant steel plates. The employer also did not ensure that press brakes were safely set up for operations, including requirements to adequately secure dies for bending operation, and by providing job-made dies that had their structural integrity limits and maximum load rating and capacity established through appropriate engineering design, construction, and testing methods.

29 CFR  1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.   a.  Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about November 19, 2025 and at times prior, employees performed a die change activities on the 400/750-ton press brakes. The employer did not ensure that applicable energy control procedures were documented and provided to employees to utilize to ensure hazardous energy control when performing the service/maintenance activity. As a result, the employee was exposed to struck-by and/or caught-in hazards.

29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a.  Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about November 19, 2025 and at times prior, employees performed die changes on the  400/750-ton Chicago Dreis & Krump  press brakes. The employer did not ensure employees received authorized employee training under 29 CFR 1910.147(c)(7) to ensure employees could recognize all hazardous energy sources present on the equipment and were knowledgeable in the applicable energy control procedure(s) necessary to isolate and control the release of hazardous energy during die-changing operations. As a result, employees were exposed to struck-by hazards and/or caught-in hazards.

The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):  a.  Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about November 19, 2025 and at times prior, employees were exposed to machine hazards associated with the 400/750-ton Chicago Dreis & Krump press brakes  while performing a die change activities. The employer did not ensure that energy control application steps were implemented as the machine was not shutdown [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], the release of stored energy [(d)(5)(i)], and verification of energy source isolation [(d)(6)], were not implemented to protect employees from stuck-by and/or caught-in hazards.

Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about November 19, 2025 and at times prior, employees operated sit down propane forklifts to move parts/materials throughout the facility and for press brake die setting activities.  The employer did not provide operator employees with training that consisted of a combination of formal instruction, practical training, and/or evaluation prior to operating powered industrial equipment (forklifts). As a result, employees were exposed to struck-by hazards.

29 CFR  1910.1030(d)(3)(ii): Use. The employer shall ensure that the employee uses appropriate personal protective equipment unless the employer shows that the employee temporarily and briefly declined to use personal protective equipment when, under rare and extraordinary circumstances, it was the employee's professional judgment that in the specific instance its use would have prevented the delivery of health care or public safety services or would have posed an increased hazard to the safety of the worker or co-worker. When the employee makes this judgement, the circumstances shall be investigated and documented in order to determine whether changes can be instituted to prevent such occurrences in the future.   a.  Blackburn's Fabrication, Inc. located 2467 Jackson Pike, Columbus, OH 43223: On or about October 14, 2025,  the employer did ensure employees cleaning/sanitizing an area following a serious injury incident involving blood used personal protective equipment such as but not limited to gloves, eye/face protection and protective clothing. The following occupational exposure resulted in employees being exposed to bloodborne pathogens and/or other potentially infections materials.
