29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Westover Masonry, LLC. at 1224 6th Street, Brookings, SD 57006: On or about and at times prior to November 24, 2025, the employer did not ensure that operators were trained to operate the Sky Jack SJ1056 THS all-terrain forklift prior to operation on the site. This condition exposed the employee to various hazards with not being properly trained prior to operation.

29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a)Westover Masonry, LLC. at 1224 6th Street, Brookings, SD 57006: On or about and at times prior to November 24, 2025,  the employer did not ensure that employees were protected from falls while working between a supported scaffold system and the Hydro-mobile scaffold system.   This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)Westover Masonry, LLC. at 1224 6th Street, Brookings, SD 57006: On or about and at times prior to November 24, 2025, the employer did not ensure that employees were provided with adequate training on scaffolding systems prior to conducting masonry activities from the supported scaffolding system. This condition exposed employees to various hazards while working from scaffolding systems.  (b)Westover Masonry, LLC. at 1224 6th Street, Brookings, SD 57006: On or about and at times prior to November 24, 2025, the employer did not ensure that employees were provided with adequate training on scaffolding systems prior to conducting masonry activities from the Hydro-mobile scaffolding system. This condition exposed employees to various hazards while working from scaffolding systems.  Westover Masonry, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.454(a), which was contained in OSHA inspection number 1737629, citation number 1, item number 1a and was affirmed as a final order on 6/21/2024, with respect to a workplace located at  304 15th Avenue, Brookings, SD 57006.

29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a)Westover Masonry, LLC. at 1224 6th Street, Brookings, SD 57006: On or about and at times prior to November 24, 2025, the employer was not maintaining frequent and regular jobsite inspections. Per document request, the employer had conducted jobsite inspections at other jobsites but no inspections were conducted at the address where the incident had taken  place.  This condition exposed employees to hazards at the jobsite by not being identified by a competent person.
