29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) On or about November 25, 2025, at 1926 Skees Road, West Palm Beach, FL 33411, the employer did not develop and implement a monitoring program for employees exposed to noise equal to or exceeding the 8-hour time-weighted average of 85 dBA while working in the block plant. An employee was exposed to continuous noise levels at 225.3% of the allowable 8-hour time-weighted average action level (85 dBA). The equivalent dBA of 225.3% is 95.8 dBA. The sampling was performed for 468 minutes, and zero exposure was assumed for the 12-minute period not sampled. b) On or about November 25, 2025, at 1926 Skees Road, West Palm Beach, FL 33411, the employer did not develop and implement a monitoring program for employees exposed to noise equal to or exceeding the 8-hour time-weighted average of 85 dBA while working in the block plant. An employee was exposed to continuous noise levels at 162.7% of the allowable 8-hour time-weighted average action level (85 dBA). The equivalent dBA of 162.7% is 93.5 dBA. The sampling was performed for 465 minutes, and zero exposure was assumed for the 15-minute period not sampled. c) On or about November 25, 2025, at 1926 Skees Road, West Palm Beach, FL 33411, the employer did not develop and implement a monitoring program for employees exposed to noise equal to or exceeding the 8-hour time-weighted average of 85 dBA while working in the block plant.
