29 CFR 1910.22(d)(2): The employer did not ensure that hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired. On or about: November 24, 2025 Location: 333 Saw Mill River Rd. Elmsford, NY 10523 Bakery department a) Employees were exposed to burning hazards while unloading baking racks with hot baked goods from Baxter standing rotating ovens while the surface condition of the floor is damaged and uneven. An employee unloading a rack of baked goods from the standing oven was burned when the rack rolled over the damaged and uneven surface causing the baked goods to fall onto the employee. Employee received multiple first and second degree burns to the upper areas of both arms and one third degree burn to upper area of left arm. Employees were not protected.
