29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening was less than 39 inches (1.0 m) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: a) Job site, 341 Butler Street, Etna, PA: On or about November 24, 2025 during construction activities, the employer did not ensure employees working near wall openings were using appropriate fall protection systems/devices, exposing them to fall hazards of up to approximately 15 feet.

29 CFR 1926.20(b)(2): A program was not provided for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer: a) Job site, 341 Butler Street, Etna, PA: On or about November 24, 2025 during construction activities, the employer did not implement a system of hazard identification and correction at the job site. Deficiencies noted included, but were not limited to, failing to ensure fall protection was used along wall openings where the windows had been removed. b) Job site, 341 Butler Street, Etna, PA: On or about December 18, 2025 during construction activities, the employer did not implement a system of hazard identification and correction at the job site. Deficiencies noted included, but were not limited to, tripping hazards present due to excessive floor board buildup occurred and not having smooth handrails on stairs going up to the 2nd floor.
