OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a) New residential construction located at 3205 Cherry Grove Way, Cumming, GA 30040: On or about 12/02/2025, the employer exposed an employee to fall hazards of approximately 14-feet, 4-inches to the lower ground level, in that a employee was allowed to work from an elevated position standing on a stack of plywood sheathing that measured 4 feet long by 8 feet wide that was resting on the forks of a JCB rough terrain forklift truck.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located at 3205 Cherry Grove Way, Cumming, GA 30040, Roof Trusses: On or about 12/02/2025, the employer exposed employees to fall hazards of approximately 19-feet, to the lower level, in that a fall protection system was not provided to employees engaged in framing activities using the trusses as a walking working surface.
