29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: At the manufacturing facility located at 704 SW 10th Street in Blue Springs, Missouri 64015, on or about 12/1/2025: The employer did not assess, identify and evaluate the respiratory hazards associated with the fire suppression chemicals including but not limited to SF1230, Argon, FM200, Genetron 125, and Fike 5-1-12, and the products of thermal decomposition from the material left inside the containers during heat treatment. Employees were potentially exposed to chemicals present during hydrotesting operations.

29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required: At the manufacturing facility located at 704 SW 10th Street in Blue Springs, Missouri 64015, on or about 12/1/2025 and at times prior: The employer did not ensure that containers previously used to contain fire suppression chemicals and not completely emptied, were clearly identified and marked, with the contents of the container to warn the employees interacting with the containers throughout the hydrotesting process. Employees were exposed to inhalation of vapors and gases, eye and skin irritation, from chemicals including but not limited to SF1230, Argon, FM200, Genetron 125, and Fike 5-1-12, and the products of thermal decomposition from the material left inside the containers during heat treatment.

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): (i) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (ii) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; (iii) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, (iv) The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. At the manufacturing facility located at 704 SW 10th Street in Blue Springs, Missouri 64015, on or about 12/1/2025: The employer did not provide hazard communication training including all required elements to the employees working in the hydrotesting area with fire suppression chemicals and the products of thermal decomposition of such chemicals. Employees were potentially exposed to chemicals present during hydrotesting operations.
