29 CFR 1926.502(i)(4): Covers for holes in floors, roofs, and other walking/working surfaces were not color coded or marked with the word "HOLE" or "COVER" to provide adequate warning of the hazard:  Location: 37-28 Crescent Street, Long Island City, NY 11101- Back of the building fourth floor.  On or about Monday December 8th, 2025, the employer did not ensure a hole cover was color coded or marked to provide warning of the fall hazard of the floor hole. Employees were exposed to falling approximately 30 feet to the lower level.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.502(i)(3): Fall protection systems criteria and practices. All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees.   Location: 37-28 Crescent Street, Long Island City, NY 11101- back of the building on the fourth floor  On or about Monday December 8th, 2025, the employer did not ensure a floor cover was secured to prevent accidental displacement. Employees were exposed to falling approximately 30 feet to the ground below.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.  Axon Construction Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.502(i)(3), which contained in OSHA inspection #1757637, citation number 1 item number 1 and was affirmed as a final order on 08/09/2024 with respect to a workplace located at 45-36 21st Street, Long Island City, NY 11101.

On or about Monday December 9th, 2025, the employer did not report a work-related fatality within 8 hours to OSHA.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
