29 CFR 1926.502(b)(3):Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) On or about December 9, 2025; top-floor area; Employees engaged in housekeeping duties, receiving materials, and framing tasks were at risk of falls, estimated at 30-feet, due to deficiencies in the guardrail system. Specifically, the construction of the guardrails did not comply with safety standards, as the rails lacked adequate bracing and were not sufficiently secured to withstand the required load of 200 pounds. The condition observed in the guardrail design heightens the potential for workplace accidents/falls, particularly in areas where employees are routinely working at or near the railing. b) On or about December 9, 2025; top-floor area; Employees engaged in housekeeping, receiving materials and framing tasks were exposed to a significant fall hazard, estimated at 30 feet, due to deficiencies in the construction of the guardrail system. Specifically, the system failed to meet the industry-standard requirement of withstanding 200 pounds of force, which is critical for ensuring safety. This shortcoming was the inadequate number of nails used or lack of to secure the guardrails, compromising their stability and integrity. The condition observed in the guardrail design heightens the potential for workplace accidents/falls, particularly in areas where employees are routinely working at or near the railing. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.503(a)(2):The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a) On or about December 9, 2025; Top-floor area; Employees engaged in carpentry work were not adequately trained by a qualified individual on how to identify potential hazards, understand necessary safety requirements, and implement effective methods to abate those risks specifically related to the installation of railing systems. This includes, but is not limited to, understanding the structural integrity required to support various weight loads, adhering to industry standards for the quantity and type of nails to be used for securing the rails, and recognizing the importance of proper spacing and alignment in railing installation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
