29 CFR 1910.29(b)(1): The employer did not ensure that  guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section).  De-palletizer platform. On or about December 10, 2025 the top edge height of the top rail provided for the de-palletizer platform was 37.5 inches above the walking-working surface.

De-palletizer platform. On or about December 10, 2025 the midrail installed on a platform was 11 inches above the walking-working surface. The midpoint of the guardrail system as configured on the day of inspection was 18.75 inches above the walking-working surface.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  De-palletizer. On or about December 10, 2025 the employer did not have an Energy Control Procedure in place for any equipment within the facility. A manager suffered serious injuries when servicing equipment that had not been isolated or rendered inoperative.

On or about December 10, 2025 the unguarded chains of a drive system used to raise and lower pallets measured approximately four inches from the top rail of a stair rail system.
