29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  Location: Job site;  On or about 12/12/2025, Michael Leary Contracting, Inc. as a controlling employer, did not ensure that frequent and regular inspections of the job site were performed by a competent person. As a result, sub-contractor employees from LKC General Construction Corp were exposed to hazards in the following instances:  a) sub-contractor employees and Michael Leary Contracting Job site Supervisor were not protected from overhead struck by hazards while working below an active roofing project where roofing materials, tools, and debris could have fallen 25-feet or more to the lower level and struck the employees in their heads without being protected by hardhats or other overhead protection.  b) sub-contractor employees were allowed to utilize pneumatic nail guns to install roofing materials to the roof of the apartment building without the use of eye and face protection.  c) sub-contractor employees were allowed to be exposed to falls from 25-feet or more from the roof of the residential apartment building under construction who were not tied off to fall protection equipment while performing roofing activities.  Michael Leary Contracting, Inc.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1837179, citation number 1, item number 1 and was affirmed as a final order on 09/30/2025, with respect to a workplace located at 292 Cambridge St, Lexington, MA 02421.
