1910.132(d)(1)(i): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall, select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment. (a) On or about December 17, 2025, the employer did not select, provide, and require the use of the types of PPE that would best protect employees from workplace hazards, such as but not limited to exposure to liquified or compressed hydrogen gas (asphyxiant), 93% sulfuric acid (corrosive), 99% Sodium Hydroxide (corrosive), ethylene glycol (irritant), and rust remover(serious eye damage, burns).

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: Procedures for selecting respirators for use in the workplace; Medical evaluations of employees required to use respirators; Fit testing procedures for tight-fitting respirators; Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators; Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and Procedures for regularly evaluating the effectiveness of the program. (a) On or about December 17, 2025, the employer had not established and implemented a written respiratory protection program with worksite-specific procedures for employees who were required to wear respirators, such as but not limited to FGS Series powered air purifying respirator (PAPR) and 3M 7502 half face tight fitting facepiece respirator with 3M 6001 organic vapor cartridges, in the workplace while welding and spray painting.

Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. (a) On or about December 17, 2025, the employer did not provide a suitable eyewash station that provided 15 minutes of continuous flow within the work area for the first floor where employees weighed and mixed dry sodium hydroxide 99% (corrosive) into five gallon buckets of water and stirred it with a stick, while wearing safety glasses and rubber gloves.

29 CFR 1910.1200(e)(1): Written hazard communication program. Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and, the methods the employer will use to inform employees of the hazards of non-routine tasks (for example, the cleaning of reactor vessels), and the hazards associated with chemicals contained in unlabeled pipes in their work areas (a) On or about December 17, 2025, the employer had not developed, implemented, or maintained a written hazard communication program for employees who worked with hazardous chemicals, such as but not limited to liquified or compressed hydrogen gas (asphyxiant), 93% sulfuric acid (corrosive), 99% Sodium Hydroxide (corrosive), ethylene glycol (irritant), rust remover(serious eye damage, burns), and hexavalent chromium (carcinogen.)

Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. (a) On or about December 17, 2025, the employer had not ensured that each container of hazardous chemicals in the workplace was correctly labeled, tagged, or marked with product identifier, signal word, hazard statement(s), pictogram(s); and precautionary statement(s) or specific information regarding the physical and health hazards of the hazardous chemical.

Chemical specific information was not always available through labels and Safety Data Sheets (SDSs).
