29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) On our about December 23,2025, at the above mentioned address, the employees were exposed to fall hazards of approximately 23 feet ground to eave while performing residential roofing work. Leonardo Mendez dba L&M Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1603758, citation 1, item 2, and was affirmed final order on September 28, 2022, with respect to a workplace located at 4324 Lacebark Ln. Naperville, IL. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. The program did not enable each employee to recognize the hazards of falling and did no trained each employee in the procedures to be followed in order to minimize these hazards. a) On or about December 23, 2025, at the above mentioned address. the employer did not ensure that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards in excess of 23 feet while performing roofing activities on a residential structure without using fall protection.
