29 CFR 1910.29(b)(10):(10) When guardrail systems are used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails; (a) Hopper - On or about December 17, 2025, the employer did not ensure that a removable top rail and midrail, or their equivalents, were placed across the access opening at the hoist area when employees were not performing hoisting operations, thereby exposing employees to falls greater than 4 feet. While standing in front of the hopper, an employee was struck by a forklift and fell approximately 10 feet into the hopper below.

29 CFR 1910.178(n)(4): Industrial truck driver(s) were not required to travel with the load trailing whenever the load obstructed forward view: a. Hopper, Door 5 - On or about December 17, 2025, the employer did not ensure that employees operating forklifts travel with the load trailing when the load obstructed the operator's forward view, thereby exposing employees to struck-by hazards. While carrying a load with an obstructed forward view, a forklift operator struck an employee and caused the employee to fall approximately 10 feet into a receiving hopper.
