29 CFR  1926.50(g): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:   (a)   Right-side of the house - On or about January 5, 2026, the employer exposed employees to a safety hazard, in that the employer did not furnish an eye wash station or an acceptable means of continuous eye flushing for at least 15 minutes, for employees who worked with a corrosive chemical, including Magnolia Color Masonry Cement.

(a)   Right-side of the house - On or about January 5, 2026, the employer exposed employees to a struck-by hazard, in that hard hats were not worn by employees on the ground where there was bricklaying activity overhead.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  (a) Right-side of the house - On or about January 5, 2026, the employer exposed employees to a fall hazard, in that scaffold platforms had gaps of 19" on the second tier of the scaffold, with a 13' fall to ground distance.  (b) Right-side of house - On or about January 5, 2026, the employer exposed employees to a fall hazard, in that scaffold platforms had gaps of 38" inches wide on the third tier of the scaffold, with an 18' fall to ground distance.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   (a)   Right-side of the house - On or about January 5, 2026, the employer exposed employees to a fall hazard, in that a ladder was not installed for access to a scaffold platform with up to an 18' fall to ground distance.

(a)  Right-side of the house - On or about January 5, 2026, the employer exposed employees to a fall hazard, in that employees did not have fall protection while working from a scaffold with a 18' fall to ground distance.

29 CFR  1926.454(c): The employer had reason to believe that an employee lacked the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, and the employer did not retrain such employee so that the requisite proficiency was regained:    (a)   Right-side of the house - On or about January 5, 2026, the employer exposed employees to a fall hazard, in that employees displayed an inability to work safely on scaffolds and near scaffolds.   Vital safety components such as: ladders, guardrails and decks were removed while the scaffold  was  still in use.
