OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to nip points, caught between, and crushed by hazards while using a in-house manufactured below-the-hook lifting device on a Jib Crane . a. On or about January 13, 2026, and at times prior, employees performing boom installation work were using an in-house manufactured below-the-hook lifting device to hoist booms weighing approximately 1,100 to 1,700 lbs .from ground level to the debris-tank installation point. The non-engineered, unrated, and unmarked lifting device exposed employees to caught-between and crushing hazards.
