29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Builders Building (Top Shop): On February 19, 2026, a nail gun operator was exposed to occupational noise at 143.1% of the permissible daily noise exposure (eight hour time weighted average of 85 dBA at the 80 dB criterion level) during the 479 minute sampling period. For a full eight hour shift this would be equivalent to an average sound level of 92.5 dBA. The employer did not administer a continuing, effective hearing conservation program to protect employees from hearing loss.  (b) Builders Building: On February 19, 2026, a nail gun operator was exposed to occupational noise at 119.5% of the permissible daily noise exposure (eight hour time weighted average of 85 dBA at the 80 dB criterion level) during the 478 minute sampling period. For a full eight hour shift this would be equivalent to an average sound level of 91.2.0 dBA. The employer did not administer a continuing, effective hearing conservation program to protect employees from hearing loss.  (c) Saw Room: On February 19, 2026, a saw operator was exposed to occupational noise at 66.7% of the permissible daily noise exposure (eight hour time weighted average of 85 dBA at the 80 dB criterion level) during the 438 minute sampling period. For a full eight hour shift this would be equivalent to an average sound level of 87.0 dBA. The employer did not administer a continuing, effective hearing conservation program to protect employees from hearing loss.  Mountain Pallet LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1910.95(c)(1), which was contained in OSHA inspection number 1789026, citation number 1, item number 1 and was affirmed as a final order on February 21, 2025.  Abatement certification and documentation required within 30 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
