OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a.) Grinder 1 Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026;  The employer did not complete a periodic inspection of the hoist used to lift bins of chips from the extruders onto the grinding platform. 1/2 ton wall mount Gorbel straight beam rail with an underhung 1 ton Milwaukee hoist (model: 9566, SN JMA0965XB).   b.) Grinder 2 Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026;  The employer did not complete a periodic inspection of the hoist used to lift bins of chips from the extruders onto the grinding platform.  1/2 ton wall mount Gorbel straight beam rail with an underhung 1 ton Coffing hoist (model: JLC2016, SN JMA5058Q8).

Grinder 1, Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026; Employees were exposed to a fall hazard of approximately 6 feet 11 inches when walking by the loading area on the platform at Grinder 1, no guard rails were present.  b.) Grinder 2, Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026; Employees were exposed to a fall hazard of approximately 6 feet 11 inches when walking by the loading area on the platform at Grinder 2, no guard rails were present.  c.) Large Mixers, Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026; Employees were exposed to a fall hazard of approximately 5 feet 6 inches when when placing raw materials into the large mixers. No guardrails were present where pallets of material are positioned on the platform.  d.) Smaller Mixers, Nortek Powder Coating LLC, 5900 Success Drive, Rome, NY, 13440, on or about 2/17/2026; Employees were exposed to a fall hazard of approximately 5 feet when placing raw materials into the large mixers. No guardrails were present where pallets of material are positioned on the platform.  Abatement certification is required.
