29 CFR 1926.20(b)(2):The employer failed to initiate and maintain frequent and regular inspections of the job site, materials, and equipment, as required by a competent person(s):  (a) On or about February 27, 2025, the Company Owner was the competent person on site and did not conduct frequent and regular inspections to identify and address hazardous conditions. Specifically, the anchor points used to connect to the fall protection system were not adequately inspected. This resulted in unverified anchor points that were not properly installed and secured to the roof, resulting in a fall hazard of 10 feet at the eave to 17 feet 9 inches at the gabled ridge ends.  (b) On or about February 27, 2025, the Company Owner was the competent person on site and did not conduct frequent and regular inspections to identify and address hazardous conditions. The Company Owner did not ensure that ropes and lanyards were properly installed. The ropes and rope grabs were installed with excessive slack which would allow the employee to  contact the ground below in the event of a fall. This resulted in a fall hazard of 10 feet at the eave to 17 feet 9 inches at the gabled ridge ends.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) On or about February  27, 2026, employees conducting roofing activities on a new construction residential structure to include paper and shingle installation were not protected from falling to the lower level, when exposed employees were not tied-in to a properly installed and maintained personal fall arrest system, or other means of fall protection implemented. This exposed employees to a fall hazard of 10-feet at the eave up to 17-feet 9-inches at the gabled ridge ends onto gravel and dirt.

29 CFR  1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.   (a) On or about February  27, 2026, employees conducting roofing activities on a new construction residential structure to include paper and shingle installation were not protected from falling to the lower level by a properly installed and maintained personal fall arrest system. The fall protection anchor points being used to secure ropes were not properly installed, in-that only two fasteners (screws) were used to secure anchor points. This condition exposed employees to a fall hazard of 10-feet at the eave up to 17-foot 9-inches at the gabled ridge ends onto gravel and dirt.

29 CFR  1926.503(c)(3):The employer did not retrain affected employees  who had already  been trained but Inadequacies were discovered in affected employee's knowledge and use of fall protection systems or equipment that indicated that the employee had not retained the requisite understanding or skill.  (a) On or about February  27, 2026, the employer did not ensure that employees conducting roofing activities on a new construction residential structure to include paper and shingle installation work were properly trained or had retained the  knowledge required to identify deficiencies in the installation and use of the fall protection system used by six employees on this site. There employees were not tied-in to fall system and were not protected from falling to the lower level by a personal fall arrest system, or other means of fall protection. This exposed employees to a fall hazard of 10-feet onto gravel and dirt.  (b) On or about February  27, 2026, the employer did not ensure that employees conducting roofing activities on a new construction residential structure to include paper and shingle installation work were properly trained or had retained the  knowledge required to identify deficiencies in the installation and use of the fall protection system used by six employees on this site. Two employees were tied-in to an improperly rigged fall system and were not protected from falling to the lower level by a personal fall arrest system, or other means of fall protection. This exposed employees to a fall hazard of 10-feet onto gravel and dirt.  (c) On or about February  27, 2026, the employer did not ensure that employees conducting roofing activities on a new construction residential structure to include paper and shingle installation work were properly trained or had retained the  knowledge required to identify deficiencies in the installation and use of the fall protection system when two employees were tied-in to an improperly anchored fall system and were not protected from falling to the lower level. This exposed employees to a fall hazard of 10-feet onto gravel and dirt.
