29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI): (a) Welding & Fabrication Building; On or about March 17, 2026, an exposure assessment to determine employee 8-hour time-weighted average exposures to chromium (VI), during stainless steel welding operations, was not conducted. The base metal and welding wire contained approximately 18 percent chromium.

29 CFR 1910.1026(l)(1)(iii): The employer did not include chromium (VI) in the hazard communication program established to comply with the HCS (§ 1910.1200). The employer did not train employees in accordance with the requirements of HCS and paragraph (l)(2) of this section: (a) Welding & Fabrication Building; On or about March 17, 2026, employees performing welding on stainless steel were exposed to chromium (VI). The hazards of chromium (VI) were not included in the employer's hazard communication program, nor were employees provided training in accordance with 29 CFR 1910.1026(l)(2).
