29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the temporary jobsite located at 802/804 North Edwards Avenue Wichita, Kansas, employees engaged in roofing activities were exposed to dermal, ingestion, and inhalation hazards from exposure to gasoline, roofing and flashing cement, and asphalt shingles. The employer had not developed and implemented a hazard communication program.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the temporary jobsite located at 802/804 North Edwards Avenue Wichita, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided training on the chemical hazards of gasoline, flashing cement and asphalt shingles. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, gasoline can act as a fueling agent due to its extreme flammability as a liquid and vapor.

29 CFR  1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  (Construction Reference: 1926.59)  At the temporary jobsite located at 802/804 North Edwards Avenue Wichita, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets for gasoline, flashing cement, and asphalt shingles at the job site. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, throat, lung and respiratory tract irritation, silicosis/siderosis, vomiting and/or diarrhea, suspected of causing cancer and may be fatal if swallowed and enters airways.
