29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) New construction located at Milbrae Walk, Lot #94, Flowery Branch, GA 30524, Scaffold: On or about 3/24/2026, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees using these tools at 125 PSI while engaged in siding activities.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New construction located on Lot #94 Millbrae Walk, Flowery Branch, GA 30524, Scaffold: On or about 3/24/2026, the employer exposed employees to fall hazards of approximately 20-feet, 6-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in siding installation activities working from a pump jack scaffold system.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  a) New construction located at Milbrae Walk, Lot #94, Flowery Branch, GA 30524, Scaffold: On or about 3/24/2026,  the employer exposed employees to respiratory hazards due to silica exposure from cutting Hardie board siding, in that engineering controls, work practices, or respiratory protection as described in Table-1 were not adhered to while using a circular saw with no vacuum attachment.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:   a) New construction located at Milbrae Walk, Lot #94, Flowery Branch, GA 30524, Scaffold: On or about 3/24/2026,  the employer exposed employees to respirable hazards, in that the employer did not assess all employees who may be exposed to silica health hazards through monitoring to ensure they are not overexposed.
