29 CFR 1910.178(m)(4): The employer shall prohibit arms or legs from being placed between the uprights of the mast or outside the running lines of the truck. On March 23, 2026 at establishment located at 825 East Wisconsin Avenue, Appleton, Wisconsin; the employer did not ensure that employees remained inside of the running lines of the truck, in that an employee was exposed to caught between hazards from the frame upright and an affixed guard for an elevator call button panel while operating an Nissan electric forklift V506 (Model: CYGM02L25S; Serial: CYGM02-001745).

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On March 23, 2026 at establishment located at 825 East Wisconsin Avenue, Appleton, Wisconsin; the employer did not ensure that each powered industrial truck was inspected at least daily, when in use, to identify any conditions that could adversely affect the safety of the vehicles.
