29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about April 21, 2026, at a construction site located at 7993 South Patricia Court, Franklin, WI 53152, employees were installing shingles on the west side of the roof of an existing duplex roof with a 4:12 pitch, were not using fall protection. This exposed employees to a fall hazard of approximately nine (9) feet from roof to the ground below onto concrete on the south side of the roof and a fall hazard of approximately 19 feet from roof to the ground below on the north side of the roof.

29 CFR 1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head. (a) On or about April 21, 2026, at a construction site located at 7993 South Patricia Court, Franklin, WI 53152, an employee was installing shingles on the south side of the roof of an existing duplex roof, was connected to the fall protection lanyard line by the hip d-ring instead of the back d-ring. This exposed employee to muscular skeletal injuries in the event of a fall due to the positioning of the lanyard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about April 21, 2026, at a construction site located at 7993 South Patricia Court, Franklin, WI 53152, the two (2) portable extension ladders being used by employees to access the roof of the structure on the west side of the duplex, did not extend at least three feet above the upper point of contact with the eave. This exposed employees accessing and egressing the roof, to an approximate nine (9) foot fall hazard.
