29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) On or about April 21, 2026, in the Disassembly Department, disassembly employees were permitted to use N95 filtering face-piece respirators and elastomeric half-mask and full-face air purifying respirators during sanding/grinding operations on a voluntary basis. The employer failed to provide Disassembly Department employees with the information contained in Appendix D for the voluntary use of respiratory protection. Such exposure is likely to result in respiratory tract irritation.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a) On or about and times prior to April 21, 2026, in the Disassembly Department, employees were permitted to use an elastomeric full-face air purifying respirator equipped with OV/Particulate combination cartridges on a voluntary basis during sanding/grinding operations on rail car floors and stairs. The employer failed to ensure that the medical evaluation element of the written respiratory protection program was implemented for voluntary users of elastomeric respirators. Such exposure is likely to result in respiratory tract irritation and exacerbate underlying health conditions such as asthma.
