29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about April 29, 2026, the employer did not ensure that employees working from and walking the interior wall framing were protected from falling to the level below. The fall height of the top of the framing to the level below was determined to be 9' om accordance with the blueprint drawings onsite. An employee was observed standing on the framing and hammering in nails. Barney's Construction LLC was previously cited for a violation of an equivalent occupational safety and health standard 29 CFR 19263.501(b)(13), which was contained in OSHA inspection number 1580774, citation number 1, item number 3 and was affirmed as a final order on 4/18/22, with respect to a workplace located at 3619 Bailey Ave. , Cleveland, OH.
