29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) On or about May 1, 2026, at the above addressed jobsite, the employer failed to establish and implement a written Respiratory Protection Program for employees who were required to wear tight-fitting elastomeric respirators when conducting handheld power saw operations.  The respiratory protection program shall include, at a minimum, procedures for selecting respirators; medical evaluations; fit testing; procedures for proper use in routine and reasonably foreseeable emergency situations; procedures for cleaning, inspecting, repairing and discarding respirators; employee training regarding respiratory hazards they are exposed to, proper uses and limitations of respirators; and procedures for regularly evaluating the effectiveness of the respirator program.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   a) On May 1, 2026, at the above addressed jobsite, the employer did not ensure an employee required to wear a tight-fitting half facepiece respirator while using a handheld power saw was clean shaven and did not have facial hair that could interfere with the seal of the respirator, thereby, exposing the employee to the hazards associated with silica.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a)  On or about May 1, 2026, at the above addressed jobsite, an employee was using a handheld power saw to cut concrete curbs that contained silica.  The employer did not ensure an integrated water delivery system was utilized to minimize dust exposure, thereby exposing the employee to the hazards associated with respirable crystalline silica.  Kreative Scape Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1153(c)(1), which was contained in OSHA inspection number 1784479, citation number 1, item number 1 and was affirmed as a final order on February 21, 2025, with respect to a workplace located at 80th Ave. and 191st Street in Tinley Park, IL.
