29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about June 1, 2026, employee(s) engaged in commercial construction operations located at 703 South 11th Street, Nebraska City, Nebraska. Employee(s) were exposed to struck-by and fall hazards in the following but not limited to instances:  1.  Powered industrial truck being utilized by untrained employees.   2.  Contractors on site working from platform not secured to forklift with fall protection.

29 CFR  1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  On or about June 1, 2026, it was observed that employee(s) engaged in commercial construction operations located at 703 South 11th Street, Nebraska City, Nebraska. Employee(s) were exposed to fall hazards while working from a platform that was not attached to the forks of the power industrial truck.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about June 1, 2026, it was observed that employee(s) engaged in commercial construction operations located at 703 South 11th Street, Nebraska City, Nebraska. Employee(s) were exposed to fall hazards in that the employer had employee(s) working at heights greater than 14-feet without any form of fall protection in place.

29 CFR  1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.   On or about June 1, 2026, the employer failed to provide written certification upon request that employees were provided training on fall protection prior to working at heights.
