General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to emloyees in that: a) Employee was exposed to the recognized hazard of asphyxiation while working in a confined space which could have contained an oxygen deficient atmosphere. This condition existed on or about December 6, 1985 while an employee was working inside a beer fermentation tank No. 1526 that contained the residuals of the fermentation process which generates Carbon Dioxide (CO2), thus lowering the oxygen content. This hazard could have been prevented by conducting air sampling prior to allowing tank entry and if necessary, requiring tank ventilation and/or use of respiratory protection.
