Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing of likely to cause death
or serious physical harm to employees in that employees were exposed to
increased risk of contracting Hepatitis B or Acquired Immune Deficiency
Syndrome or other blood borne diseases:
a) Health care workers, nurses aids, per diem nurses, radiology
technicians and housekeeping personnel, working through the
inpatient areas of the facility on or about 3/1/89, on the evening
(3 p.m. to 11 p.m.) shift were exposed to the hazards of being
infected by Hepatitis B Virus (HBV) and/or Human Immunodeficiency
Virus (HIV) through possible direct contact with blood or other
body fluids.
Such exposure could result in the onset of clinical symptoms of
acute Hepatitis B, anorexia, abdominal pain, jaundice and the
potential for becoming a chronic carrier of the Hepatitis B and/or
Human Immunodefiency Virus.
Feasible and useful abatement methods of reducing this hazard, among
others are:
1) Provide training and education to all health care workers in the
modes of transmission and prevention of Hepatitis B and/or Human
Immunodeficiency Virus as outlined in the Centers for Disease
Control (CDC) Guidelines: June 24, 1988, Vol. 37, No. 24.
2) Establish a Hepatitis B vaccination policy which shall address all
circumstances warranting such vaccinations.
All such employees shall be offered Hepatitis B vaccinations in amounts
and at times prescribed by standard medical practice.
3) Requirements for offering the Hepatitis B vaccinations are taken
from the Centers for Disease Control, Morbidity and Mortality Weekly
Reports, June 24, 1988, Vol. 37. No. 24, Page 378, Infection Control
efforts for Human Immunodeficiency Virus (HIV), Hepatitis B Virus
(HBV), and othe bloodborne pathogens must focus on preventing
exposure to blood as well as on delivery of HBV immunization.
4) Develop follow-up procedures for implementation after possible
exposure that include HBV/HIV testing of the source and employee
(after obtaining proper consent) and other appropriate procedures
as outlined by CDC guidelines: June 24, 1988, Vol. 37 No. 24.
