Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to serious injury, such as from being ejected from the vehicle during an accident as the result of riding as a passenger in a Loader Backhoe that was not designed to carry passengers: Construction Site, Dirt Roadway - An employee was riding as a passenger in a vehicle not designed to carry passengers (Model 655C, Ford, Tractor Loader Backhoe). ABATEMENT NOTE: One feasible method of abatement is to prohibit employees from riding.
