Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) When employees are working in the same location as a faller, falling trees, precautions shall be taken so that trees shall not be fell if a falling tree endangers any workman, line or any unit in operation, as required by the State of Idaho Minimum Safety Standardsand Practices for logging, Chapter 8, Standard 18 - Falling and Bucking, Section 18.6. One method of abatement is to work the faller in another area or strip. Among other methods, one feasible and accepted abatment method to correct this hazard is: 1) Maintain a safe distance (a separation of at least two tree lengths) between fallers and other employees. 2) Establish a formal training program to better inform employees of safe logging procedures.
