General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the dumbwaiter in the Cafeteria of Building 3, Second Floor, does not have a door to guard the full width and height of the dumbwaiter opening. The absence of a dumbwaiter door places employees at risk of falling into the dumbwaiter shaft and/or becoming crushed between the dumbwaiter and the shaft, resulting in broken bones and/or amputations. One feasible method of correcting the hazard is to install a dumbwaiter door as referenced in ASME A17.1b, 1995, Section 700, Hoistways, Hoistway Enclosures, and Related Construction, Rule 700.11, Protection of Hoistway Landing Openings. (NOTE: The employee must ensure that when the door is installed that it has a hoistway-door locking device to prevent operation of the dumbwaiter of the door is open, and to prevent someone from opening the door unless the dumbwaiter is at the landing. This hoistway-door locking device is required per ASME A17.1b, 1995, Section 700.12.)
