Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)Lower Base, next to Tan Holdings - Employee under L&T's control was
working on top
of shipping containers stacked two high, attaching the wire rope sling
from a crane to the
corners of the container without the use of fall protection exposing him
to a fall hazard
of 16 feet resulting in broken bones, fractures and contusions. Among
other methods,
one feasible and acceptable abatement method to correct this hazard is to
use safety
harnesses attached to an anchorage point to prevent employees from falling
over the
edge.
