General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling into an approximately 10 feet deep open pit containing hot water. Employees passed through a guard rail that protected the pit to perform the job duty of hooking and unhooking spools of wire on the elevator tray: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that no workers pass through the guardrail structure unless otherwise provided alternate protection to prevent them from stepping into or falling into the water and then only with effective lockout of the elevator tray and effectively closing grid openings in the elevator tray platform if servicing and/or repair requires accessing the platform.
