Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The cover(s) for the hoistway floor opening located north of the control station on No. (2) Tin Lane, east dragout section at the Yorkville, Ohio plant were not secured against accidental displacement, thus exposing employees to the hazard of falls to another level of approximately 9 1/2 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1) Design hoistway floor opening cover(s) with fastening features that are intended to prevent accidental displacement; and 2) Provide and use removable standard guardrail system for all exposed side(s) of hoistway floor opening during uses of the opening(s).
