Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls of 15 feet from an elevated platform: a)DFS Guam: Warehouse and maintenance employees are at risk of falling up to 15 feet to the concrete floor of the warehouse while being lifted by reach trucks and pickers while standing in a 41 inch by 48 inch plywood elevating platform with side walls that only reach 33 inches in height. Note: Among other feasible and acceptable abatement methods would be to: 1.Construct the elevating platform in accordance with ANSI B56.1-1988, Section 7.34.1.3, or equivalent which requires restraining means positioned at a vertical height not less than 36 inches nor more than 42 inches. 2.Provide a scaffold or solid construction. 3.Provide a ladder.
