Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)An Employee was not wearing his seatbelt while operating the NISSAN
forklift Z5,
number F1 outside the warehouse. Employee was loading a Lucky Supplies Van
with
goods. Employee is exposed to injuries from not being restrained in the
forklift in case
of tipping and/or rollover.
Among other methods, one feasible abatement and acceptable abatement
method to correct this
hazard is to follow the operator manual under use of seatbelt: Always wear
seatbelt while
operating the machine to reduce the risk of personal injuries and as
referenced in ITSDF B56,
1-2005 "Safety Standard for Low Lift and High Lift Trucks".
