29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Hazard Communication Program, Warehouse - Employees use chemical products such as Prestone brake fluid, Spectrum 10W-40 SG engine oil, and Gunk Engine Brite protectant. Some safety data sheets (SDSs) are available. The employer's written hazard communication program was deficient in the following ways: 1. A current list of chemical products used in the warehouse; 2. A complete collection of Safety Data Sheets; 3. A description of the pictogram system in accordance with the 2013 revised standard

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: Hazard Communication Program, Warehouse - Employees were not trained on the new label elements (i.e. pictograms and signal words) and the new SDS formation as required by the revised Hazard Communication Standard. Employees use hazardous chemicals to maintain PIT's such as but not limited to Prestone brake fluid, Gunk Engine Brite protective, and Spectrum 10W-40 SG engine oil at the work site, and were exposed to chemical hazards.
