Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.An employee was not wearing his seatbelt while operating the YALE forklift #14 in the export side of the warehouse. Employee was transporting pallets of goods in and out of the warehouse. Employee was exposed to injuries from not being restrained in the forklift in case of tipping and/or rollover. Among other methods, one feasible abatement and acceptable abatement method to correct this hazard is to follow the operator manual under Use of Seatbelt: Always wear seatbelt while operating the machine to reduce the risk of personal injuries; and as referenced in ITSDF B56.1- 2005 "Safety Standard for Low Lift and High Lift Trucks"d
