Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Outbound Warehouse, Both on the Ramp and Inside the Warehouse: The employer failed to ensure that an employee operating the Yale forklift, FL-14, Model GP40LGJGA, S/N E2090 was wearing a seatbelt. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER USE OF SEATBELT. CONTINENTAL MICRONESIA CARGO WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 5(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION 106401904, CITATION 1, ITEM 1, ISSUED ON MAY 25, 2006, WITH RESPECT TO A WORKPLACE IN TAMUNING, GUAM.ING,
